Terms and Conditions for CRONUS SERVICE INC

  1. OWNER’S RESPONSIBILITIES

The Owner is responsible for providing water, gas, sewer, and electrical utilities unless otherwise agreed in writing. Electricity and water must be available at the site. The Owner agrees to allow CRONUS SERVICE INC and its equipment access to the property. The Owner is responsible for removing or protecting personal property, and CRONUS SERVICE INC is not liable for any damage to carpets, drapes, furniture, driveways, lawns, shrubs, etc. Property lines must be clearly identified and guaranteed by the Owner.

  1. FEES, TAXES, AND ASSESSMENTS

The Owner is responsible for all taxes, permits, fees, and assessments related to the project. CRONUS SERVICE INC may assist in obtaining necessary permits, but all expenses are borne by the Owner. The Owner must promptly provide funds to acquire permits when requested. Any additional charges from public utilities or bodies, such as hook-up fees or assessments, are the Owner’s responsibility.

  1. WARRANTY AND MAINTENANCE REQUIREMENTS
  • HVAC Installation: 3-year labor warranty with an option to extend to match the equipment manufacturer’s warranty, provided the Owner arranges biannual maintenance checks.
  • Plumbing and Water Heaters: Manufacturer warranties apply, with options for extended labor warranties up to 10 years. Repairs not completed within 24 days will result in free replacement (subject to manufacturer availability).
  • Electrical Work: 3-year labor warranty applies to electrical panel installations, rewiring, and EV charger setups.
  • Solar Panels: 25-year linear performance warranty, 15-year roof penetration warranty, and 3-year workmanship warranty.
  • Other Installations: Labor warranties vary by service type, from 1 to 10 years, with manufacturer warranties applying to parts and equipment.

Failure to maintain the equipment as outlined may void warranties.

  1. LABOR AND MATERIALS

CRONUS SERVICE INC shall pay for labor and materials used in the project unless the Owner is in arrears on payments. The Owner will be notified of any increases in material costs exceeding 10% of the original estimate.

  1. INSURANCE
  • Owner’s Insurance: The Owner must procure “all risk” insurance covering the contract price, naming CRONUS SERVICE INC as an additional insured. Failure to do so allows CRONUS SERVICE INC to secure insurance at the Owner’s expense.
  • CRONUS SERVICE INC Insurance: The company carries Commercial General Liability and Workers’ Compensation Insurance. Evidence of coverage is available upon request.
  1. PAYMENTS AND RIGHT TO STOP WORK

Payments are due as outlined in the agreement. Late payments incur interest at 1% per week. CRONUS SERVICE INC may stop work if payments are not made on time. Work will resume once payments are current.

  1. CLEAN-UP

CRONUS SERVICE INC will remove debris and surplus materials, leaving the site in a broom-clean condition upon project completion.

  1. EXTRA WORK AND CHANGE ORDERS

Extra work or changes to the scope require written authorization. Change orders must specify scope, cost adjustments, and impact on the completion timeline. Costs incurred due to unforeseen site conditions or changes mandated by authorities are the Owner’s responsibility.

  1. DELAYS AND FORCE MAJEURE

CRONUS SERVICE INC is not liable for delays caused by acts of God, labor disputes, material shortages, governmental actions, or other events beyond its control. Adjustments to the project timeline and costs will be communicated as necessary.

  1. MECHANICS LIEN WARNING

Unpaid subcontractors or suppliers may file a mechanics lien against the property. To avoid liens, the Owner should ensure payments are made directly to subcontractors and suppliers through joint checks when possible.

  1. LIMITED WARRANTY

CRONUS SERVICE INC guarantees all work for one year, excluding issues covered under manufacturer warranties. Warranties do not cover damage caused by the Owner or third parties.

  1. RIGHT TO CURE

If the Owner identifies deficiencies, they must provide written notice. CRONUS SERVICE INC will address issues within 10 days of receiving notice.

  1. ARBITRATION OF DISPUTES

Disputes arising from this agreement will be resolved through arbitration in accordance with California law. Arbitration will take place in the county where the project was performed, with costs shared equally by both parties.

  1. VALIDITY

If any provision of this agreement is deemed invalid, the remaining provisions shall remain in full force and effect.

  1. SCOPE OF AGREEMENT

This document constitutes the entire agreement between the Owner and CRONUS SERVICE INC. Modifications must be made in writing and signed by both parties.
